An exchange Tuesday between a federal appeals judge and the lawyer for 21 young people who have sued the government over climate change got to the crux of the novel yet complex case.
About 45 minutes into the hearing before a packed courtroom in downtown Portland, Judge Andrew D. Hurwitz of the 9th U.S. Circuit Court of Appeals cut off Eugene lawyer Julia Ann Olson. Olson’s young clients are asserting a constitutional right to a sustainable climate and want the court to order the United States to prepare an energy plan that transitions the nation away from fossil fuels.
